TCEQ Approves Fines Totaling $468,012

The Texas Commission on Environmental Quality (TCEQ) today approved penalties totaling $468,012 against 75 regulated entities for violations of state environmental regulations.

Agreed orders were issued for the following enforcement categories: Three agricultural, 18 air quality, six dry cleaner, two Edwards Aquifer, six industrial waste discharge, two multi-media, three municipal solid waste, 10 municipal waste discharge, nine petroleum storage tank, five public water system, and five water quality. In addition, there were default orders issued for the following categories: One agriculture, one dry cleaner, and one on site sewage facility authorization.

Penalties were also assessed against three regulated entities following hearings at the State Office of Administrative Hearings for petroleum storage tank and on-site sewage facility violations.

The TCEQ gears up to issue more funds for lower emissions
With new legislative funding, the Texas Emissions Reduction Plan kicks off 2008 with an offering of $137.5 million in incentive grants and rebates. This financial assistance is intended to lower emissions from diesel equipment and heavy-duty vehicles.

The Legislature approved $290.6 million for TERP grants this biennium, an increase of almost $60 million over the previous period. Of the appropriation, $137.5 million is available for distribution in early 2008.

Miki Kirby joined Ronnie Jones Law

Ronnie Jones welcomes Miki Kirby as a paralegal in the firm on November 27th.  Miki has worked as a Legal Secretary and Legal Assistant in the Austin area for the past six years.  She received a Bachelor of Science in Criminal Justice from Southwest Texas State University in 2003 and is an active member of the Phi Alpha Delta Pre-Law Fraternity.

Pipeline Explosion near U.S. 69 and 60th Street in Port Arthur
Ronnie Jones has been engaged to investigate and work on this case on behalf of a large number of residents that were adversely impacted by the subject explosion in the Port Arthur area.

LITIGATION

On January 31, 2008 Ronnie Jones filed a lawsuit on behalf of his clients seeking damages in excess of 4.8 million dollars against Capitol Blue Haven Pools, Inc. and its subcontractors for construction defects on real property owned by his clients and personal injuries to his clients related to their exposure to toxic mold and for the company and its subcontractors violations of state law.

Washington County Train Derailment
Mr. Jones filed a lawsuit against a railroad company and others seeking damages in excess of one million dollars for injuries to his client's real and personal property that she alleges resulted from a train derailment and the emergency response activities that were performed by the train company and its subcontractors.
