TCEQ Approves Fines Totaling $505,368

Penalties Levied Against 89 Entities Today - The Texas Commission on Environmental Quality (TCEQ) today approved penalties totaling $505,368 against 89 regulated entities for violations of state environmental regulations.

Agreed orders were issued for the following enforcement categories: Two agricultural, 14 air quality, two dry cleaner, one Edwards Aquifer, 23 field citations, one industrial and hazardous waste, one industrial waste discharge, two licensed irrigators, five multi-media, eight municipal waste discharge, one on-site sewage facility, nine petroleum storage tank, five public water system, one underground injection control, eight water quality, and one water right. In addition, default orders were issued for the following categories: one dry cleaner, one multi-media, and three petroleum storage tank.

The TCEQ gears up to issue more funds for lower emissions
With new legislative funding, the Texas Emissions Reduction Plan kicks off 2008 with an offering of $137.5 million in incentive grants and rebates. This financial assistance is intended to lower emissions from diesel equipment and heavy-duty vehicles.

The Legislature approved $290.6 million for TERP grants this biennium, an increase of almost $60 million over the previous period. Of the appropriation, $137.5 million is available for distribution in early 2008.

Ronnie Jones welcomes Hollis Henley II, a May 2008 graduate of University of Texas School of Law in Austin, TX.  Hollis interned at the Texas Commission on Environmental Quality (TCEQ), Public Interest Counsel and performed as a Judicial Intern for the The Honorable William Wayne Justice, U.S. District Court, Western District of Texas.  With his already immense experience, Hollis is a great addition to the firm.

Port Arthur, Texas - A lawsuit was filed today in State District Court in Jefferson County, Texas on behalf of 323 current or past property owners and tenants who suffered and sustained personal injuries of various severities due to the Union Carbide/TPC Pipeline Explosion on October 17, 2007. Its effects have been devastatingly clear: the death of a 16 year old male youth, whose mother contends that he died from the explosion’s aftermath. Local officials released available monitoring data, supporting the inclusive adverse impact of the explosion on the residents.

Based on his research and investigation since the explosion, Plaintiffs’ attorney, Ronnie Jones, Attorney and Counselor at Law, Austin, Texas, filed suit on behalf of his clients seeking the recovery of several million dollars in damages for personal injuries to his clients. According to Mr. Jones, “The City of Port Arthur has a long and well documented history of explosions  and toxic emissions events that have caused injuries and fatalities, public evacuation, property losses, ecosystem damage, and public concern about the commitment to public safety of the involved company.” Jones, who himself was raised in Port Arthur, feels it is time to increase awareness about the potential for consequences of runaway chemical reactions that release highly toxic vapors into nearby communities.

Through the lawsuit, Mr. Jones and his clients intend to raise awareness on a local and national level about pipeline threats to Small Town America in the Gulf Coast Area as part of a campaign involving the community’s right-to-know, community clean-up efforts, and clean air initiatives - all aimed at chemical accident prevention. “We know that injuries resulting from the aftermath of pipeline explosions affects more than just the person injured; his or her family suffers as well as the community-at-large, and we must look for new opportunities to manage the integrity of pipelines and raise the bar on pipeline safety,” stated Mr. Jones.  More>>

On October 13, 2009, Ronnie Jones will speak at the 2009 Government Law & Liability Conference on Judicial Review of Contested Cases at 2:00 - 2:45 p.m. He will address common issues raised in these lawsuits, usually handled by regulatory and licensing agencies. Some of the issues include questions about proper forum, original and exclusive jurisdiction, exhaustion of remedies, and more.

Ronnie Jones has been engaged to investigate and work on this case on behalf of a large number of residents that were adversely impacted by the subject explosion in the Port Arthur area.

On April 20, 2009, Ronnie Jones filed suit on behalf of his client against Progressive County Mutual Insurance Company seeking significant damages for alleged violations of federal employment laws.

On December 30, 2008, Ronnie Jones filed suit on behalf of his client against Crown Castle International Corporation and others seeking significant damages for injury to his client’s property.

On July 30, 2008, our firm filed a lawsuit on behalf of clients against Geico Casualty Company seeking significant damages related to an accident insurance contract.

Washington County Train Derailment
Mr. Jones filed a lawsuit against a railroad company and others seeking damages in excess of one million dollars for injuries to his client's real and personal property that she alleges resulted from a train derailment and the emergency response activities that were performed by the train company and its subcontractors.
